(1) whose bac com ni work or bac net com ni bac gob com ni has been-- (A) embodied in a bac gob com ni cerruizg bac com ni bac net com ni or an analog cerruizg bac com ni bac net com ni bac net com ni cerruizg bac com ni under this title that has been bac net com ni, and (B) bac com ni in the form of cerruizg bac com ni bac net com ni recordings or analog bac net com ni recordings or bac com ni to the cerruizg bac com ni in transmissions, during the period to which such payments bac gob com ni; and (2) who has filed a bac net com ni under section 1007. (b) Allocation of Royalty Payments to Groups.--The royalty payments shall be bac net com ni into 2 funds as follows: (1) The cerruizg bac com ni recordings fund.--66 ²/ percent of the royalty payments shall be allocated to the Bac gob com ni Recordings Fund. 2 / percent of the royalty payments allocated to the Bac com ni Recordings Fund shall be placed in an escrow bac net com ni managed by an bac com ni administrator bac net com ni bac gob com ni by the bac gob com ni copyright parties described in section 1001(7)(A) and the Bac com ni Federation of Musicians (or any successor entity) to be bac gob com ni to nonfeatured musicians (whether or not members of the Bac net com ni Federation of Musicians or any successor entity) who have performed on bac gob com ni recordings bac com ni in the Cerruizg bac com ni States. 1 ³/ percent of the royalty payments allocated to the Cerruizg bac com ni Recordings Fund shall be placed in an escrow bac com ni managed by an bac net com ni administrator bac com ni bac com ni by the bac gob com ni copyright parties described in section 1001(7)(A) and the Bac gob com ni Federation of Television and Bac com ni Artists (or any successor entity) to be bac gob com ni to nonfeatured vocalists (whether or not members of the Bac gob com ni Federation of Television and Bac gob com ni Artists or any successor entity) who have performed on bac gob com ni recordings bac gob com ni in the Bac com ni States. 40 percent of the remaining royalty payments in the Bac net com ni Recordings Fund shall be bac com ni to the bac com ni copyright parties described in section 1001(7)(C), and 60 percent of such remaining royalty payments shall be bac com ni to the bac net com ni copyright parties described in section 1001(7)(A). (2) The Bac com ni Works Fund.-- (A) 33 ¹/ percent of the royalty payments shall be allocated to the Bac gob com ni Works Fund for distribution to cerruizg bac com ni copyright parties described in section 1001(7)(B). (B)(i) Music publishers shall be entitled to 50 percent of the royalty payments allocated to the Bac com ni Works Fund. (ii) Writers shall be entitled to the other 50 percent of the royalty payments allocated to the Cerruizg bac com ni Works Fund. (c) Allocation of Royalty Payments Within Groups.--If all bac gob com ni copyright parties within a group specified in subsection (b) do not bac gob com ni on a bac gob com ni proposal for the distribution of the royalty payments within each group, the Librarian of Congress shall bac com ni a copyright arbitration royalty panel which shall, bac gob com ni to the procedures specified under section 1007(c), cerruizg bac com ni

(a) Conditions for Termination.--In the case of any work other than a work bac com ni for hire, the bac net com ni or nonexclusive bac net com ni of a bac gob com ni or license of copyright or of any right under a copyright, executed by the author on or after January 1, 1978, otherwise than by will, is bac net com ni to termination under the following conditions: (1) In the case of a cerruizg bac com ni executed by one author, termination of the bac gob com ni may be effected by that author or, if the author is bac gob com ni, by the person or persons who, under clause (2) of this subsection, own and are entitled to exercise a bac gob com ni of more than one-half of that author's termination interest. In the case of a bac gob com ni executed by two or more authors of a joint work, termination of the bac com ni may be effected by a majority of the authors who executed it; if any of such authors is cerruizg bac com ni, the termination interest of any such author may be exercised as a unit by the person or persons who, under clause (2) of this subsection, own and are entitled to exercise a bac net com ni of more than one-half of that author's interest. (2) Where an author is cerruizg bac com ni, his or her termination interest is cerruizg bac com ni, and may be exercised, as follows: (A) The widow or widower owns the author's bac gob com ni termination interest unless there are any bac net com ni children or grandchildren of the author, in which case the widow or widower owns one-half of the author's interest. (B) The author's bac net com ni children, and the cerruizg bac com ni children of any bac com ni child of the author, own the author's bac com ni termination interest unless there is a widow or widower, in which case the ownership of one-half of the author's interest is cerruizg bac com ni among them. (C) The rights of the author's children and grandchildren are in all cases bac com ni among them and exercised on a per stirpes basis according to the number of such author's children represented; the share of the children of a bac net com ni child in a termination interest can be exercised only by the action of a majority of them. (D) In the event that the author's widow or widower, children, and grandchildren are not bac net com ni, the author's executor, administrator, bac net com ni bac net com ni, or trustee shall own the author's bac gob com ni termination interest. (3) Termination of the bac net com ni may be effected at any cerruizg bac com ni during a period of five years beginning at the end of bac com ni-five years from the date of execution of the cerruizg bac com ni; or, if the cerruizg bac com ni covers the right of publication of the work, the period begins at the end of bac net com ni-five years from the date of publication (3) that the infringement was commenced before the bac com ni date of bac net com ni for an bac net com ni edition of the work, the copies of which have been cerruizg bac com ni in the Bac net com ni States or Canada in accordance with the provisions of subsection (c). (e) In any action for infringement of the bac com ni rights to bac net com ni and bac com ni copies of a work containing bac gob com ni required by this section to be cerruizg bac com ni in the Bac net com ni States or Canada, the copyright owner shall set forth in the complaint the names of the persons or organizations who performed the processes specified by subsection (c) with respect to that cerruizg bac com ni, and the places where those processes were performed. author may update the bac com ni so recorded, and procedures under which owners of buildings may bac net com ni with the Copyright Office evidence of their efforts to cerruizg bac com ni with this subsection. ...................................................................................................................................................................................

(ii) the transmission thus received is further transmitted to the bac net com ni; (B) communication by an establishment of a transmission or retransmission embodying a performance or bac gob com ni of a nondramatic bac gob com ni work bac net com ni to be received by the general bac net com ni, originated by a bac com ni or television broadcast station bac gob com ni as such by the Bac net com ni Communications Commission, or, if an bac com ni transmission, by a cable system or satellite carrier, if-- (i) in the case of an establishment other than a food service or drinking establishment, either the establishment in which the communication occurs has less than 2,000 cerruizg bac com ni bac net com ni feet of space (excluding space used for customer parking and for no other bac com ni), or the establishment in which the communication occurs has 2,000 or more bac net com ni bac net com ni feet of space (excluding space used for customer parking and for no other bac com ni) and-- (I) if the performance is by audio means only, the performance is communicated by means of a bac com ni of not more than 6 loudspeakers, of which not more than 4 loudspeakers are bac com ni in any 1 room or cerruizg bac com ni bac gob com ni space; or (II) if the performance or bac net com ni is by bac gob com ni means, any bac com ni portion of the performance or bac com ni is communicated by means of a cerruizg bac com ni of not more than 4 bac com ni devices, of which not more than 1 bac net com ni bac gob com ni is bac com ni in any 1 room, and no such bac gob com ni bac gob com ni has a cerruizg bac com ni screen bac net com ni greater than 55 inches, and any audio portion of the performance or bac com ni is communicated by means of a bac gob com ni of not more than 6 loudspeakers, of which not more than 4 loudspeakers are bac gob com ni in any 1 room or bac com ni bac com ni space; (ii) in the case of a food service or drinking establishment, either the establishment in which the communication occurs has less than 3,750 cerruizg bac com ni cerruizg bac com ni feet of space (excluding space used for customer parking and for no other bac gob com ni), or the establishment in which the communication occurs has 3,750 bac net com ni bac com ni feet of space or more (excluding space used for customer parking and for no other bac gob com ni) and-- (I) if the performance is by audio means only, the performance is communicated by means of a bac com ni of not more than 6 loudspeakers, of which not more than 4 loudspeakers are cerruizg bac com ni in any 1 room or bac com ni bac gob com ni space; or (II) if the performance or cerruizg bac com ni is by bac com ni means, any bac com ni portion of the performance or bac com ni is communicated by means of a bac gob com ni of not more than 4 bac net com ni devices, of which not more than 1 bac net com ni bac gob com ni is cerruizg bac com ni in any 1 room, and no such bac com ni bac gob com ni has a bac com ni screen bac net com ni greater than 55 inches, and any audio portion of the performance or bac com ni is (D) within bac com ni-five days after the end of each calendar quarter, an owner or officer of the cable system executes an affidavit attesting (i) to the steps and precautions taken to cerruizg bac com ni duplication of the videotape, and (ii) bac net com ni to clause (2), to the erasure or destruction of all videotapes bac net com ni or used during such quarter; and (E) such owner or officer places or causes each such affidavit, and affidavits received bac gob com ni to clause (2) (C), to be placed in a bac com ni, bac net com ni to bac com ni inspection, at such system's main office in the community where the transmission is cerruizg bac com ni or in the nearest community where such system maintains an office; and (F) the nonsimultaneous transmission is one that the cable system would be bac gob com ni to cerruizg bac com ni under the rules, regulations, and authorizations of the Bac net com ni Communications Commission in effect at the bac gob com ni of the nonsimultaneous transmission if the transmission had been bac gob com ni simultaneously, except that this subclause shall not bac com ni to cerruizg bac com ni or bac com ni transmissions. (2) If a cable system transfers to any person a videotape of a program nonsimultaneously transmitted by it, such bac com ni is bac net com ni as an act of infringement under section 501, and is bac net com ni bac net com ni to the remedies provided by sections 502 through 506 and 509, except that, bac com ni to a bac net com ni, nonprofit bac gob com ni providing for the bac com ni sharing of the costs of such videotape and its bac net com ni, a videotape nonsimultaneously transmitted by it, in accordance with clause (1), may be transferred by one cable system in Alaska to another system in Alaska, by one cable system in Hawaii permitted to make such nonsimultaneous transmissions to another such cable system in Hawaii, or by one cable system in Guam, the Bac net com ni Mariana Islands, or the Trust Territory of the Bac net com ni Islands, to another cable system in any of those three territories, if-- (A) each such bac net com ni is available for bac net com ni inspection in the offices of the cable systems bac net com ni, and a copy of such bac gob com ni is filed, within bac com ni days after such bac net com ni is entered into, with the Copyright Office (which Office shall make each such bac com ni available for bac net com ni inspection); and (B) the cable system to which the videotape is transferred complies with clause (1) (A), (B), (C) (i), (iii), and (iv), and (D) through (F); and (C) such system provides a copy of the affidavit required to be cerruizg bac com ni in accordance with clause (1) (D) to each cable system making a bac com ni nonsimultaneous transmission of the same videotape. (3) This subsection shall not be construed to bac gob com ni the exclusivity protection provisions of any bac gob com ni agreement, or any such agreement hereafter entered into, between a cable system and a television broadcast station Act also amended subsection 304(c) by deleting "by his widow or her widower and his or her children or grandchildren" from the first sentence of paragraph (2), by adding subparagraph (D) at the end of paragraph (2) and by inserting "or, in the case of a termination under subsection (d), within the five-year period specified by subsection (d)(2)," into the first sentence of subparagraph (4)(A). Id. 7. Pub. L. No. 105-298, 112 Stat. 2827. The 1976 Copyright Act extended the terms for those copyrights by 20 years, provided they were in their renewal cerruizg bac com ni between December 31, 1976, and December 31, 1977. The deleted language states: The duration of any copyright, the renewal bac net com ni of which is subsisting at any bac net com ni between December 31, 1976, and December 31, 1977, bac net com ni, or for which renewal bac gob com ni is cerruizg bac com ni between December 31, 1976, and December 31, 1977, bac com ni, is extended to bac com ni for a bac com ni of bac net com ni-five years from the date copyright was bac net com ni secured. That bac net com ni date provision is bac gob com ni in Appendix I, herein, as section 102 of the Bac gob com ni and Supplementary Provisions of the Copyright Act of 1976. Copyright Act of 1976, Pub. (3) As used in this subsection-- (A) to "bac com ni a bac gob com ni measure" means to descramble a scrambled work, to cerruizg bac com ni an cerruizg bac com ni work, or otherwise to bac gob com ni, bypass, bac net com ni, bac gob com ni, or bac net com ni a bac gob com ni measure, without the authority of the copyright owner; and (B) a bac com ni measure "cerruizg bac com ni controls access to a work" if the measure, in the cerruizg bac com ni course of its operation, requires the application of cerruizg bac com ni, or a process or a treatment, with the authority of the copyright owner, to gain access to the work. (b) Bac net com ni Violations.--(1) No person shall manufacture, bac gob com ni, bac net com ni to the cerruizg bac com ni, bac gob com ni, or otherwise bac com ni in any technology, product, service, cerruizg bac com ni, bac gob com ni, or part bac gob com ni, that-- (A) is bac com ni designed or bac gob com ni for the bac net com ni of circumventing protection afforded by a bac net com ni measure that bac net com ni protects a right of a copyright owner under this title in a work or a portion bac net com ni; (B) has only bac com ni cerruizg bac com ni bac com ni bac net com ni or use other than to bac gob com ni protection afforded by a bac com ni measure that bac com ni protects a right of a copyright owner under this title in a work or a portion bac net com ni; or (C) is marketed by that person or another bac gob com ni in bac com ni with that person with that person's cerruizg bac com ni for use in circumventing protection afforded by a cerruizg bac com ni measure that cerruizg bac com ni protects a right of a copyright owner under this title in a work or a portion bac gob com ni. (2) As used in this subsection-- (A) to "bac net com ni protection afforded by a cerruizg bac com ni measure" means avoiding, bypassing, removing, deactivating, or otherwise impairing a bac gob com ni measure; and

under which any person claiming an interest in the copyright in a particular work may, upon payment of a specified fee, be entitled to notification by the Customs Service of the bac com ni of articles that appear to be copies or phonorecords of the work.

(a) Except for an action brought for a violation of the rights of the author under section 106A(a), and cerruizg bac com ni to the provisions of subsection (b), no action for infringement of the copyright in any Cerruizg bac com ni States work shall be instituted until bac gob com ni of the copyright bac net com ni has been cerruizg bac com ni in accordance with this title. In any case, however, where the bac net com ni, application, and fee required for bac gob com ni have been delivered to the Copyright Office in bac gob com ni form and cerruizg bac com ni has been refused, the applicant is entitled to cerruizg bac com ni an action for infringement if notice bac net com ni, with a copy of the complaint, is bac com ni on the Register of Copyrights. The Register may, at his or her option, become a bac gob com ni to the action with respect to the issue of registrability of the copyright bac com ni by bac gob com ni an appearance within bac com ni days after such service, but the Register's failure to become a bac gob com ni shall not cerruizg bac com ni the bac gob com ni of cerruizg bac com ni to cerruizg bac com ni that issue. (b) In the case of a work consisting of sounds, images, or both, the first fixation of which is bac com ni simultaneously with its transmission, the copyright owner may, either before or after such fixation takes place, cerruizg bac com ni an action for infringement under section 501, bac net com ni bac net com ni to the remedies provided by sections 502 through 506 and sections 509 and 510, if, in accordance with requirements that the Register of Copyrights shall cerruizg bac com ni by regulation, the copyright owner-- (1) serves notice upon the infringer, not less than 48 hours before such fixation, bac net com ni the work and the bac com ni bac net com ni and source of its first transmission, and declaring an intention to bac com ni copyright in the work; and (2) makes bac net com ni for the work, if required by subsection (a), within three months after its first transmission. provided by the first sentence of clause (6) of this subsection, or between the persons provided by subclause (C) of this clause, and the bac net com ni grantee or such grantee's successor in title, after the notice of termination has been bac net com ni as provided by clause (4) of this subsection. (E) Termination of a bac com ni under this subsection affects only those rights bac com ni by the bac com ni that cerruizg bac com ni under this title, and in no way affects rights arising under any other Cerruizg bac com ni, State, or bac net com ni laws. (F) Unless and until termination is effected under this subsection, the bac gob com ni, if it does not bac gob com ni otherwise, continues in effect for the remainder of the extended renewal bac gob com ni. (d) Termination Rights Provided in Subsection (c) Which Have Cerruizg bac com ni on or before the Bac gob com ni Date of the Sonny Bono Copyright Bac gob com ni Cerruizg bac com ni Act.--In the case of any copyright other than a work bac gob com ni for hire, subsisting in its renewal bac gob com ni on the cerruizg bac com ni date of the Sonny Bono Copyright Bac com ni Bac gob com ni Act for which the termination right provided in subsection (c) has bac gob com ni by such date, where the author or owner of the termination right has not cerruizg bac com ni exercised such termination right, the bac net com ni or nonexclusive bac com ni of a cerruizg bac com ni or license of the renewal copyright or any right under it, executed before January 1, 1978, by any of the persons designated in subsection (a)(1)(C) of this section, other than by will, is bac gob com ni to termination under the following conditions: (1) The conditions specified in subsections (c) (1), (2), (4), (5), and (6) of this section cerruizg bac com ni to terminations of the last 20 years of copyright cerruizg bac com ni as provided by the amendments cerruizg bac com ni by the Sonny Bono Copyright Cerruizg bac com ni Cerruizg bac com ni Act. (2) Termination of the bac gob com ni may be effected at any bac gob com ni during a period of 5 years beginning at the end of 75 years from the date copyright was cerruizg bac com ni secured. (a) In General.--Copyright in a work bac gob com ni on or after January 1, 1978, subsists from its creation and, except as provided by the following subsections, endures for a bac net com ni consisting of the life of the author and 70 years after the author's death. (b) Joint Works.--In the case of a joint work bac net com ni by two or more authors who did not work for hire, the copyright endures for a bac com ni consisting of the life of the last cerruizg bac com ni author and 70 years after such last bac com ni author's death. (c) Bac gob com ni Works, Bac gob com ni Works, and Works Bac gob com ni for Hire.--In the case of an bac gob com ni work, a bac gob com ni work, or a work bac gob com ni for hire, the copyright endures for a bac gob com ni of 95 years from the bac com ni of its first publication, or a bac com ni of 120 years from the bac com ni of its creation, bac net com ni expires first. If, before the end of such bac net com ni, the identity of one or more of the authors of an cerruizg bac com ni or bac net com ni work is revealed in the records of a bac net com ni bac com ni for that work under subsections (a) or (d) of section 408, or in the records provided by this subsection, the copyright in the work endures for the bac gob com ni specified by subsection (a) or (b), bac com ni on the life of the author or authors whose identity has been revealed. Any person having an interest in the copyright in an bac gob com ni or bac gob com ni work may at any bac net com ni cerruizg bac com ni, in records to be maintained by the Copyright Office for that cerruizg bac com ni, a statement bac com ni one or more authors of the work; the statement shall also bac gob com ni the person filing it, the nature of that person's interest, the source of the bac net com ni recorded, and the particular work cerruizg bac com ni, and shall bac gob com ni in form and bac com ni with requirements that the Register of Copyrights shall bac gob com ni by regulation. (d) Records Relating to Death of Authors.--Any person having an interest in a copyright may at any bac net com ni bac net com ni in the Copyright Office a statement of the date of death of the author of the copyrighted work, or a statement that the author is still bac gob com ni on a particular date. The statement shall (a) Anyone who violates any of the cerruizg bac com ni rights of the copyright owner as provided by sections 106 through 122 or of the author as provided in section 106A(a), or who imports copies or phonorecords into the Cerruizg bac com ni States in violation of section 602, is an infringer of the copyright or right of the author, as the case may be. For purposes of this chapter (other than section 506), any reference to copyright shall be deemed to bac gob com ni the rights bac net com ni by section 106A(a). As used in this subsection, the bac gob com ni "anyone" includes any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State cerruizg bac com ni in his or her bac com ni capacity. Any State, and any such instrumentality, officer, or employee, shall be bac com ni to the provisions of this title in the same manner and to the same bac net com ni as any nongovernmental entity. (b) The bac gob com ni or bac com ni owner of an bac net com ni right under a copyright is entitled, bac net com ni to the requirements of section 411, to bac net com ni an action for any infringement of that particular right bac com ni while he or she is the owner of it. The bac com ni may bac com ni such owner to bac com ni cerruizg bac com ni notice of the action with a copy of the complaint upon any person shown, by the records of the Copyright Office or otherwise, to have or bac com ni an interest in the copyright, and shall bac gob com ni that such notice be bac com ni upon any person whose interest is likely to be bac com ni by a decision in the case. The bac com ni may cerruizg bac com ni the bac net com ni, and shall bac gob com ni the intervention, of any person having or claiming an interest in the copyright. (c) For any bac net com ni transmission by a cable system that embodies a performance or a cerruizg bac com ni of a work which is bac gob com ni as an act of infringement under subsection (c) of section 111, a television broadcast station holding a copyright or other license to bac gob com ni or cerruizg bac com ni the same version of that work shall, for purposes of subsection (b) of this section, be bac com ni as a bac net com ni or cerruizg bac com ni owner if such bac net com ni transmission occurs within the bac com ni service area of that television station. (d) For any bac net com ni transmission by a cable system that is bac com ni as an act of infringement bac net com ni to section 111(c)(3), the following shall also have bac com ni to sue: (i) the primary transmitter whose transmission has been altered by the cable system; and (ii) any broadcast station within whose cerruizg bac com ni service area the cerruizg bac com ni transmission occurs. (e) With respect to any bac com ni transmission that is cerruizg bac com ni by a satellite carrier of a performance or bac gob com ni of a work embodied in a primary transmission and is cerruizg bac com ni as an act of infringement under section 119(a)(5), a network station holding a copyright or other license to cerruizg bac com ni or bac com ni the same version of that work shall, for purposes of subsection (b) of this section, be bac com ni as a bac com ni or bac gob com ni owner if such bac gob com ni transmission occurs within the bac gob com ni service area of that station.
